These Terms and Conditions (hereinafter, "T&C") govern the online purchase service that will allow for the contracting of products and/or services offered on the Mercati Generali website (hereinafter "the Website").
Mercati Generali is the owner of the Website and the supplier of the products and/or services marketed on it.
The contractual purchase relationship entails the delivery, in exchange for a price expressly determined on this Website, of a specific product or service.
Purchasing through this Website implies acceptance of the T&C in the version published at the time of accessing the Website, which implies that the User:
Has read and understood what is set out in this document.
Is a person with sufficient capacity to make a purchase.
Agrees to comply with the obligations contained in this document.

The User is responsible for the accuracy of the data provided during the online purchase process. Furthermore, in the event that the purchase on this Website requires User registration, the User has full responsibility for the use and custody of the username and password provided to them, answering for actions performed through their use. When aware, the User must notify the supplier of the loss, disclosure, or unauthorized access by a third party to their registered User private area.
Mercati Generali reserves the right to modify these T&C, without this affecting the products or services that have been acquired through the Website before such modification.


ORDERS AND PURCHASE CONDITIONS
To be able to make a purchase, the User must be over 18 years old.
To be able to place the order, the User must provide all data requested during the purchase process, which will be necessary to correctly manage their order.
To make purchases on the Website, it is necessary that the package delivery address and the billing address are located in Europe, with the exception of the Canary Islands, Ceuta, and Melilla and Switzerland where shipments are not made.

PRICE, PAYMENT METHODS AND DISCOUNT CODES
All prices of products or services on the Website include VAT and any other taxes that may be applicable. In any case, prices will be expressed in Euros (€).
The prices indicated for each product or service do not include shipping, handling, packaging, insurance, or any other service additional to the product or service purchased, unless otherwise specified. Any applicable additional cost will be communicated to the User before the formalization of the purchase.
The prices applicable to each product or service will be those published on the Website and will be applied automatically in the last phase of the purchase process. The User accepts that the economic value of some of the products or services offered may vary in real time. In any case, this will always be communicated before the formalization of the sale.
The User agrees to pay at the time of placing the order, and may pay using any of the payment methods specified on the Website.
After making the payment, the User will receive an order confirmation email, which will include a summary of the items purchased, the requested shipping method, and the delivery address.
Mercati Generali may periodically offer discount codes to its Users. These discounts can only be applied in accordance with the instructions specified by Mercati Generali in relation to each code and, in any case, Users may use a single code per order.
The use of discount codes will not be compatible with certain promotional actions and collections.


DELIVERY TIMES AND LOCATION
Mercati Generali will deliver orders to the address indicated by the User in the appropriate purchase form.
Mercati Generali does not assume any responsibility when the delivery of orders is not carried out because the data provided by the User is false, inaccurate, or incomplete, as well as for any other cause attributable to the User.
Mercati Generali will take all necessary measures so that the delivery can be made within the agreed times. Mercati Generali considers the confirmation of payment, through any of the enabled systems, a necessary condition to be able to comply with the delivery times. However, the times indicated to the User represent an estimate and may vary for logistical reasons or due to force majeure.
It will be possible to consult the delivery times in the purchase form, as well as in the FAQ section of the Website.
The delivery will be considered carried out from the moment Mercati Generali or the transport company hired by it makes the product available to the User.


WARRANTY AND REPAIRS
1.1 CONTENT AND DURATION OF THE WARRANTY
The warranty will be valid only by sending the proof of purchase (indicating the date of purchase, model, and distributor name) together with the defective product within the warranty duration period. Mercati Generali reserves the right not to offer the free warranty service if the indicated documents are not presented or if the information contained in the documents is incomplete or illegible. If the return is made within the warranty period, Mercati Generali undertakes to repair or replace the defective product or one of its parts at no additional cost. This warranty does not cover transport costs.
1.2 WARRANTY LIMITATIONS
This warranty does not cover any of the following cases:
Defects and damage due to loss, theft, fire, water, or natural disasters.
Failures or damage caused by improper use, negligence (knocks, crushing, dents, glass breakage, etc.), or accidents.
Defects and damage due to normal wear and tear of the product.
Consumables (components that should require periodic replacement during the product's life, such as batteries).

EXCHANGES AND RETURNS

1.1 DEFECTIVE PRODUCT
In case of a defective product, it will be necessary to contact us via email within 14 days of receiving the order and send us an image that clearly shows the defect so that we can verify that the product is actually defective.
In the event that the defective product must be sent to the warehouse, Mercati Generali will bear the shipping costs. Once it is verified that the product is defective, the refund or exchange will be carried out for the User in question.
1.2 ERRONEOUS ORDER
If you receive an order that does not correspond to what you purchased, you must contact Mercati Generali within 14 days of receiving the order and send us an image showing everything you received with the respective reference on the packaging, the payment and shipping receipt. We will provide you with a solution once the content has been verified.
In the event that the product must be sent to the warehouse, Mercati Generali will bear the shipping costs. Once it is verified that the order was erroneous, the refund or exchange will be carried out for the User in question.
The product must not have been used and must be sent in its original packaging with the case and any labels that accompanied it.
1.3 ORDER EXCHANGES OR RETURNS
To carry out exchanges or returns, it will be necessary to send the product to the Mercati Generali offices. The deadline for any exchange or return is 14 days from receipt of the order. 1.4 REFUND TIMES
Once the package has been returned to our offices or warehouses, it is processed before proceeding to approve the refund. The product must be sent within 14 days of receipt of the order, must not have been used, and must be delivered in its original packaging with the case and any labels that accompanied it.
If approved, a full refund of the price of the goods will be issued within 7 business days and you will be informed of the transaction via email. Once the refund is issued, you may receive it within 5-10 business days.


USE OF THE WEBSITE
The Website provides access to Internet content belonging to Mercati Generali, which the User can access. The User assumes responsibility for the use of the portal. This responsibility extends to the registration necessary to access certain services or content. During this registration, the User will be responsible for providing truthful and lawful information.

Mercati Generali reserves the right to withdraw all those comments and publications that violate the respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that threaten youth or childhood, public order or safety or that, in its judgment, are not suitable for publication.


PROTECTION OF PERSONAL DATA
Mercati Generali complies with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, Royal Decree 1720/2007 of December 21, which approves the Regulations for the development of the Organic Law, and other current regulations, and guarantees the correct use and treatment of the User's personal data. EXCLUSION OF WARRANTIES AND LIABILITY
Mercati Generali is not liable, under any circumstances, for damages of any kind that may be caused, by way of illustration: errors or omissions in the content, lack of availability of the portal or transmission of viruses or harmful or malicious programs in the content, despite having adopted all the necessary technological measures to avoid it.

PARTIAL NULLITY
In the event that any Clause of these T&C is declared null, the other Clauses will remain in force and will be interpreted taking into account the spirit of these T&C.


APPLICABLE LAW AND JURISDICTION
These conditions shall be governed or interpreted in accordance with Spanish legislation for what is not expressly established.
Mercati Generali and the User agree to submit any controversy, which may arise as a result of the provision of products or services, to the Courts and Tribunals of the buyer's domicile, if the User is a final consumer or, as the case may be, to the Courts and Tribunals of Barcelona if the User is a company.
